Changes in Law Affecting Charities Working with Children and Protected Adults

Does your charity provide services to children and/or protected adults? Recent and upcoming changes to the law may affect your organisation. Some updates are already in effect, with more coming in 2025.  To help your organisation understand and adapt to these changes, OSCRVolunteer Scotland, and Disclosure Scotland are hosting two free online information sessions.

These sessions will provide an overview of changes introduced by the Charities (Regulation and Administration) (Scotland) Act 2023 and the Disclosure (Scotland) Act 2020, explaining what they mean for your charity.

What are the main changes?

Charities (Regulation and Administration) (Scotland) Act 2023

Key updates include:

  • The publication of charity accounts and trustee names on the Scottish Charity Register.
  • New rules on automatic disqualification from being a charity trustee or having a senior management function within a charity.

Disclosure (Scotland) Act 2020

Key updates include:

  • Membership of the PVG scheme will be a legal requirement from 1st April 2025 for those carrying out a regulated role.
  • Replacing the concept of ‘regulated work’ with ‘regulated roles’, making it more easily understood. Including roles for charity trustees and board or committee members.
